3M ESPE and the Physician Payments Sunshine Law

ST. PAUL‚ Minn. – (August 1‚ 2013) – In compliance with the Physician Payments Sunshine Law – part of the Affordable Care Act of 2010 – beginning August 1, 2013, 3M ESPE and other dental manufacturers and distributors, are required to record all “transfers of value” from the company to U.S. dentists. Transfers of value include consulting fees, speaking fees, gifts and entertainment, food and beverage, travel and lodging, and payments for research, education and royalties. Excluded from the requirement are transfers of value worth less than $10.00, unless the total for the year is $100.00 or greater. Under the law, 3M ESPE must report transfers of value recorded in 2013 to the Centers for Medicare & Medicaid (CMS) by March 2014. CMS will then post the information on their public website.

Dentists are not required to take any action. The Sunshine Law does not restrict industry – dentist collaboration or interactions, nor does it prohibit payments or other transfers of value. Rather, it requires manufacturers and distributors to track and report transfers of value, as mentioned above to the federal government.

At 3M ESPE, we are committed to providing innovative products and solutions that help dentists deliver better care and improve outcomes, as well as reduce overall costs and increase efficiency. Interaction and collaboration with dentists is crucial to our efforts to advance new, safe and effective technologies that benefit patients and consumers. At the same time, we recognize that transparency of interactions between manufacturers and dentists can help assure people that dentists are making independent decisions regarding patient care.

Because collaboration with dentists is an important part of our innovation process, we are communicating with customers about these new reporting requirements.

Additional information on the Sunshine Law can be found on the AdvaMed industry association website at or Also at the U.S. CMS website
